EU Data Act Compliance Hub & Data Rights

Introduction

Welcome to the frient Data Act Compliance Hub. In accordance with Regulation (EU) 2023/2854 of the European Parliament and of the Council (the EU Data Act), frient A/S is committed to ensuring fair, transparent, and non-discriminatory access to data generated by our connected smart home products.

Because frient hardware operates on open-standard mesh protocols (Zigbee 3.0) and does not use a mandatory proprietary cloud architecture to capture or lock your data, you remain the absolute custodian of the information your devices create. This page outlines your rights, how to access or erase your data, and how to request third-party data sharing — in full compliance with the Data Act as applicable from 12 September 2025.

Section 1: Pre-Contractual Product Data Notices (Article 3)

Before you purchase, rent, or lease any connected frient device in the European Union, you have the right to know what data it generates, in what format, how often, and how you can access or erase it.

We have consolidated these technical specifications across our entire product portfolio into a single downloadable document. Please review or download this notice prior to making your purchase:

The notice covers per product:

  • The type and format of data the device is capable of generating (e.g. temperature readings in °C as JSON, power consumption in kWh as ZCL attributes)
  • The estimated volume of data generated per reporting cycle
  • Whether the device generates data continuously and in real-time (all frient sensors report on event or on a configurable interval via Zigbee)
  • Whether data is stored on-device or on a remote server — frient devices hold only transient operational state locally; no data is transmitted to or stored on Onics A/S servers
  • The intended duration of retention on device (cleared on factory reset; no remote retention by frient A/S)
  • How you may access, retrieve, and erase your data, including the technical means to do so (see Section 2 below)

If you have questions about a specific product before purchase, contact us at: info@frient.com

Section 2: How to Exercise Your Data Rights (Articles 4–5)

1. Direct Access & Real-Time Retrieval

All data generated by frient products — such as power consumption from the Smart Plug Mini 2, air quality readings from the Air Quality Sensor, or motion events from the Motion Sensor Pro — is broadcast locally on your Zigbee mesh network. You can access this data continuously and in real-time by pairing the device with any compatible third-party Zigbee controller.

Historical charting, logs, and data file exports (CSV, Excel, JSON, and other formats) are driven entirely by your chosen smart home hub ecosystem — such as Homey, Home Assistant, or SmartThings — rather than an frient A/S database. frient A/S does not hold or process your device data on remote servers.

2. Complete Data Erasure

frient does not store your smart home metrics in a remote company system. All cryptographic network keys, routing profiles, and operational parameters reside on the physical device itself.

To permanently erase all data from a frient device:

  1. Locate the physical reset button or pinhole on your device.
  2. Follow the hard factory reset sequence described in your product's installation manual (available at frient.com/manuals).
  3. This immediately and permanently clears all internal caches, network keys, and stored parameters.

If you have shared any personal data with frient A/S via our website (for example through newsletter sign-up or contact forms), you may request erasure of that data at any time by contacting: info@frient.com.

For full details on how we handle personal data collected through this website, please see our Privacy Policy.

3. Portability & Third-Party Sharing Requests

Under Article 5 of the Data Act, you have the right to instruct frient A/S to share data generated by your frient device with a third-party service provider of your choice — for example, an independent appliance repair service, a custom analytics platform, or another smart home application.

Because frient devices operate on open Zigbee 3.0 protocols and store all operational data locally on your own smart home hub, you are already in direct control of your data. You may share it with any third party at any time via your hub's local API or export functions, without requiring authorization from frient A/S.

frient A/S does not charge fees for facilitating data sharing under the Data Act.

Section 3: Third-Party Data Sharing — Conditions and Safeguards (Article 5)

Where a third-party recipient receives data derived from a frient product at your request, that recipient is bound by the following conditions under the Data Act:

  • They may only use the data for the purposes agreed with you, and not for any other commercial purpose.
  • They may not use the data to build a competing product or to assess Onics A/S's market position or commercial practices.
  • They must not transfer the data to unauthorized parties or to entities designated as "gatekeepers" under the EU Digital Markets Act (Regulation (EU) 2022/1925).
  • They must erase the data when it is no longer needed for the agreed purpose, unless you have consented to longer retention or applicable law requires otherwise.
  • They must respect all applicable trade secret protections, including those covering frient firmware, cryptographic algorithms, and hardware design (see Section 4 below).
  • They must handle any personal data in compliance with Regulation (EU) 2016/679 (GDPR).

If you believe a third party has misused data shared at your instruction, you may file a complaint with the Danish Business Authority (Erhvervsstyrelsen) as described in Section 6 of this page.

Section 4: Intellectual Property & Trade Secret Safeguards (Article 5(10))

While raw environmental data, energy consumption metrics, alarm status parameters, and other device-generated operational data are fully available to you under the Data Act, the following remain strictly classified as frient trade secrets, protected under EU Directive 2016/943 on the protection of undisclosed know-how and business information:

  • Machine code and compiled microcontroller software binaries
  • Internal hardware blueprints and PCB schematics
  • Proprietary cryptographic security algorithms and key derivation processes
  • Internal calibration coefficients and signal processing methods

The Data Act explicitly permits data holders to protect their proprietary technology. Any attempt to modify internal device microcontrollers or reverse-engineer frient firmware without written authorization from Onics A/S is strictly prohibited and may result in the immediate termination of hardware warranties and service agreements.

Section 5: Public Sector Data Access — Exceptional Need (Chapter V)

In compliance with Chapter V of the Data Act, frient A/S will cooperate with public sector bodies or EU institutions that can demonstrate an exceptional, legally backed need for data access — for example, in the context of a severe public safety emergency or critical infrastructure failure.

Given our decentralized, cloud-free local hardware architecture, frient A/S does not possess remote access to or hold telemetry logs from individual home installations. Public authorities seeking data from frient devices must direct their request to the primary smart home hub controller used by the relevant end user, as that is where operational data resides.

To submit a formal public sector request, contact: info@frient.com

Section 6: Dispute Resolution & Competent Authority (Article 8)

If you believe frient A/S has improperly handled your data access rights, unreasonably delayed a portability request, or failed to provide adequate pre-contractual information, you have a statutory right to file a complaint with the national competent authority in Denmark:

Authority: Danish Business Authority (Erhvervsstyrelsen)
Address: Langelinie Allé 17, 2100 København Ø, Denmark
Email: erst@erst.dk
Website: www.erhvervsstyrelsen.dk

Alternatively, you may contact the designated Data Act regulatory authority or data protection authority within your EU Member State of residence.

You may also contact frient A/S directly to resolve any data access dispute informally before filing a formal complaint:

Section 7: Official Data Holder Identity (Article 3)

For all legal, regulatory, and technical enquiries concerning Regulation (EU) 2023/2854, the designated data holder is:

Corporate Address: Tangen 27, 8200 Aarhus, Denmark
